Terms of Service

1. Who we are

Dolfinspeak TV is a live streaming service operated by LOLCAT LLC, a Michigan limited liability company ("Dolfinspeak TV", "we", "us", or "our"). By creating an account, watching the stream, taking part in chat, or sending a Super Chat, you agree to these Terms of Service. If you do not agree, do not use the service.

2. The service

Dolfinspeak TV runs a single, continuous live video channel with a shared chat. The service is provided as is and may change, pause, or end at any time. We do not guarantee that the stream is available without interruption.

3. Your account

You need a free account to chat or to send a Super Chat. You agree to give accurate information, to keep your login secure, and to be responsible for activity on your account. You must be at least 18 years old, or the age of majority where you live, to make any payment. We may suspend or close an account that breaks these terms.

4. Super Chats and payments

A Super Chat is an optional, one-time payment that pins your message on the broadcast. The amount you choose sets the color of the message and how long it stays pinned. Payments are processed by Stripe, our payment processor. We do not store your full card details.

Super Chats are non-refundable once your message has been shown on the live broadcast, because the service you paid for has been delivered. If a technical failure prevents your message from being shown, contact us and we will review the charge.

5. Acceptable use

You agree not to post content that is unlawful, hateful, harassing, obscene, deceptive, or that infringes anyone's rights, and not to use the service to spam, disrupt, or attempt to gain unauthorized access. We may remove any message and may block any user, at our discretion, to keep the channel usable for everyone.

6. Content and intellectual property

The stream, the site, and our marks are owned by LOLCAT LLC or our licensors. You keep ownership of the text you submit to chat, and you grant us a non-exclusive, worldwide, royalty-free license to display it on the broadcast and within the service.

7. Disclaimers

The service is provided without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent allowed by law.

8. Limitation of liability

To the fullest extent allowed by law, LOLCAT LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim.

9. Changes to these terms

We may update these terms from time to time. When we do, we will change the effective date above. Your continued use of the service after a change means you accept the updated terms.

10. Governing law

These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Michigan.
